THE ROLE OF MIXED AND UNNAMED CONTRACTS IN THE FIELD OF SPORTS

This article provides an in-depth analysis of the institution of unnamed and mixed contracts in the field of sports from the perspective of civil law. Labor/civil contracts between professional athletes and clubs, the legal nature of football player transfer agreements, and advertising and sponsorship contracts involving athletes are considered as legal constructions belonging to the group of mixed and unnamed contracts. Comparative analysis is conducted based on the legislation of the USA, the United Kingdom, Russia, other CIS countries, and Uzbekistan, as well as FIFA’s “Regulations on the Status and Transfer of Players” (RSTP). Based on scientific and practical analysis, it is argued that a football player transfer is not the “sale of goods,” but an unnamed civil-law contract concerning the transfer of entitlement rights between clubs and the registration of the athlete.
