IMPROVING INSTITUTIONAL MECHANISMS FOR ENSURING THE PROCEDURAL RIGHTS OF MINORS AND INTRODUCING THE INSTITUTION OF AN INDEPENDENT CHILD ADVOCATE

Abstract

The article analyzes the effectiveness of institutional mechanisms aimed at ensuring the procedural rights of minors in criminal proceedings. It substantiates the insufficiency of the formal model of legal protection for implementing the principle of the best interests of the child. The study highlights the formal nature of the legal representative’s participation and the absence of a clear procedural mechanism for resolving conflicts of interest. Based on international standards, the necessity of introducing the institution of an independent child advocate is justified, and amendments to criminal procedural legislation are proposed.
