LEGAL REGULATION OF CHILD MAINTENANCE OBLIGATIONS AFTER DIVORCE: A COMPARATIVE STUDY OF CHINA AND UZBEKISTAN
Elyorbek Khudayberganov ,Abstract
This article compares the legal regulation of child maintenance after divorce in the People’s Republic of China and the Republic of Uzbekistan. The study focuses on the continuity of parental obligations after divorce, methods for determining the amount of child support, contractual arrangements, judicial modification, additional expenses, duration, and enforcement. A doctrinal comparative method is applied to the Uzbek Constitution, Family Code and Supreme Court guidance, and to the Chinese Civil Code and the Supreme People’s Court judicial interpretations, including the 2025 Interpretation (II). The results show a shared child-centred principle but different techniques of quantification. Uzbekistan relies on statutory income fractions combined with a minimum threshold and the possibility of fixed-sum awards, whereas China gives courts broader discretion within a structured percentage guideline linked to the child’s actual needs, parental ability and local living standards. The article argues that both systems would benefit from stronger periodic review mechanisms, clearer treatment of irregular and digital-platform income, and practical cross-border enforcement tools.
